Welcome to Gardening Services Archway. By engaging our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our services.

1. Definitions

Client: The individual or entity that engages Gardening Services Archway for gardening services.
Services: All gardening and landscaping services provided by Gardening Services Archway as detailed in our service offerings.
Agreement: The contractual agreement between the Client and Gardening Services Archway as outlined in these Terms and Conditions.

2. Services Provided

Gardening Services Archway offers a range of gardening and landscaping services, including but not limited to:

Regular garden maintenance
Planting and pruning
Lawn care and mowing
Garden design and landscaping
Weed control and pest management

All services will be performed with due care and professionalism, adhering to industry standards.

3. Pricing and Payment Terms

Our pricing structure is based on the scope and complexity of the services required. Key points include:

Estimates: Detailed estimates will be provided before commencing any work.
Payment Schedule: Payments are to be made as follows:

50% upon acceptance of the estimate
50% upon completion of the services

Payment Methods: We accept cash, credit cards, and bank transfers.

All payments are due within 14 days of invoicing. Late payments may incur interest charges as stipulated in the invoice.

4. Cancellation Policy

If a Client needs to cancel or reschedule a service, the following terms apply:

Cancellations made at least 48 hours in advance will incur no charges.
Cancellations made within 24-48 hours may result in a 25% cancellation fee.
Cancellations made less than 24 hours before the scheduled service may incur a 50% cancellation fee.

We understand that emergencies happen and will consider exceptional circumstances on a case-by-case basis.

5. Liability and Insurance

Gardening Services Archway is fully insured for liability and workers' compensation. However, the scope of our liability is limited to direct damages arising from our negligence. We are not liable for:

Damage to existing structures not caused by our services
Pre-existing conditions within the garden or property
Acts of nature, such as storms or flooding

Clients are advised to retain their own insurance for comprehensive coverage.

6. Client Responsibilities

To ensure the effective delivery of our services, Clients agree to:

Provide accurate information about the property and garden condition
Ensure access to the property on scheduled service days
Remove any personal items or obstacles that may hinder service delivery

Failure to meet these responsibilities may result in delays or additional charges.

7. Service Scheduling and Changes

We strive to accommodate Clients' scheduling needs. However, service times are subject to availability. Key points include:

Services are scheduled based on mutual convenience
Any changes to the schedule must be communicated at least 24 hours in advance
Repeated changes may affect service continuity and may incur additional fees

We reserve the right to reschedule services in the event of unforeseen circumstances, such as extreme weather conditions.

8. Termination of Agreement

Either party may terminate the Agreement under the following conditions:

Mutual Agreement: Both parties agree to terminate the Agreement at any time.
Breach of Terms: If either party fails to comply with the Terms and Conditions, the other party may terminate the Agreement with written notice.
Convenience: Either party may terminate the Agreement for any reason with a 30-day written notice.

Upon termination, the Client is responsible for payment of all services rendered up to the termination date.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Gardening Services Archway operates. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

10. Dispute Resolution

In the event of a disagreement between the Client and Gardening Services Archway, both parties agree to seek an amicable resolution through the following steps:

Initial discussion to understand the nature of the dispute
Mediation by a neutral third party if the dispute cannot be resolved through discussion
If mediation fails, the dispute may be escalated to arbitration or legal proceedings as per the governing law

11. Privacy Policy

Gardening Services Archway is committed to protecting the privacy of our Clients. We collect and use personal information solely for the purpose of delivering our services. Key points include:

Personal information is kept confidential and is not shared with third parties without consent
Data is stored securely to prevent unauthorized access
Clients have the right to access and correct their personal information upon request

By engaging our services, Clients consent to the collection and use of their personal information as described in this Privacy Policy.

12. Amendments to Terms and Conditions

Gardening Services Archway reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes via email or through our official communication channels. Continued use of our services after such changes constitutes acceptance of the new Terms and Conditions.

13. Force Majeure

Gardening Services Archway shall not be held liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including storms, floods, earthquakes, and other natural disasters), war, terrorism, government restrictions, or other force majeure events. In such cases, we will make reasonable efforts to reschedule services or provide alternative solutions.

14. Intellectual Property

All materials provided by Gardening Services Archway, including but not limited to brochures, designs, and documentation, are the intellectual property of Gardening Services Archway. Clients are prohibited from reproducing, distributing, or using these materials without explicit written consent.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

16. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Client and Gardening Services Archway regarding the use of our services. They supersede all prior agreements, understandings, and representations, whether oral or written.

17. Acceptance of Terms

By engaging the services of Gardening Services Archway, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
